Summary of Colorado Surrogacy Law:

Colorado passed a comprehensive surrogacy supportive law in May 2021. The law protects intended parents, surrogates, and children born to surrogacy arrangements. Intended parents are not required to be married, coupled, or genetically related to the child. Both intended parent(s) and surrogates are required to have independent legal representation licensed in Colorado. Pre-birth parentage orders are easy to obtain in Colorado following the statute; however, Colorado law invalidates surrogacy parentage orders issued outside of Colorado until registered in a Colorado court of competent jurisdiction.
