Summary of Alabama Surrogacy Law
Alabama does not have a surrogacy statute and did not adopt that portion of the UPA. However, Alabama is a very friendly state for ART law and pre-birth and post birth orders for intended families are obtained regularly. Alabama operates under contract law principals for the contract phase of the process. Once the carrier is pregnant, we obtain pre-birth orders with an accompanying medical affidavit from the fertility clinic providers under the declaratory judgment act. After the child is born, we are able to obtain a “Final Orders,” which allow the birth certificate to be issued in the names of the intended parents. It is seamless. We have been successful in obtaining parentage paperwork for all types of families; genetically related, non-genetically related, as well as same sex couples.
