Summary of Montana Surrogacy Law

Montana has no laws specifically addressing surrogacy arrangements, but uncontested prebirth and post birth parentage orders are routinely granted without a hearing in some counties, including for same-sex, single, unmarried, and international intended parents. The basis for recognizing parentage under the parentage act is weaker for intended parents who are not either genetically related to a child or married to an intended parent who is genetically related to a child. Documents needed for international travel may be obtained within short time frames.
