Summary of Nebraska Surrogacy Law

The Nebraska statute holds compensated surrogacy arrangements unenforceable. Compassionate surrogacy is allowed. Nebraska allows parentage of biological mother and father to be established post-birth by notarized affidavits of maternity. In such cases the biological mother’s spouse is the presumed legal other parent of the child.
